Discussion:

The Committee considered the draft Code prepared by LW, NS and ML. The Committee noted that:

  • auDA accredited registrars and their appointed resellers will be bound by the Code under the terms of the Registrar Agreement
  • other parties who are also involved in the industry but are not a registrar or reseller may choose to voluntarily abide by the Code
  • contractual relationships in the domain name industry are structured as follows:

i. registrar licence agrement between auDA and the registrar
ii. reseller licence agreement between the registrar and the reseller
iii. domain name licence agreement between the registrar and the registrant
iv. other commercial agreement between the reseller and the registrant

  • auDA will address transfers between registrars and use of registry keys (passwords) in a separate published policy
  • the auDA Board is considering the issue of transfers of domain name licence between registrants
  • specifying the price of a domain name licence as part of a bundled service offering is a requirement under the Registrar Agreement
  • auDA does not have jurisdiction to deal with all Internet-related products and services, only those relating specifically to domain names.

The Committee agreed to make a number of changes to the draft Code including:

  • include a reference to auDA Published Policies
  • use the term "domain name supplier" to describe registrars and resellers
  • provide for regular Code review points
  • include examples of unacceptable conduct where appropriate
  • redraft section about renewal notices.

Action:

  • Draft Code to be revised as per discussion at the meeting.
  • Remaining sections of draft Code to be considered at next teleconference.
  • Aim to release draft Code as soon as possible.
