Discussion:

The Committee agreed final changes to the Code, mostly in relation to formatting and consistency of expression.

The Committee reiterated the importance of developing the Consumer Guide that was originally intended to accompany development of the Code. JW and IJ stressed the need for a consumer code / policy and related material, to address consumer needs and the many consumer issues identified during the Code development process, but which have not been covered in the Code.

IJ noted that until this meeting there had been no indication that auDA would not be proceeding with the development of a consumer safeguards policy, separate from the industry’s Code of Practice. JL advised that:

  • with the exception of transfer of domain name licences between registrants, all issues that were addressed in auDA's Draft Consumer Safeguards Policy (December 2001) have now been addressed in the Code, making the draft policy redundant
  • auDA may publish a new consumer policy in future
  • auDA does not currently have the resources to develop a Consumer Guide in the short term, but has published a number of other consumer-related documents including an information brochure and regular consumer alerts.

The Committee agreed to make a strong recommendation to the auDA Board that the development of a Consumer Guide be given high priority.

The final Code is a consensus document. The majority of Committee members present at the meeting considered that adequate opportunity was given to all members to raise and debate issues during the 8 month drafting process. It was agreed that Committee members who wish to record a dissenting position, or conditional acceptance of the Code, should do so separately (eg. write a letter to the auDA Board).

The Committee noted that there will be further opportunity for any outstanding issues to be considered at the 3, 6 and 12 month review points.

Action:

  • CL-O to send revised Code to the list after meeting
  • Committee members to send final comments by cob 19/8
  • JL to request permission from ACIF and ADMA to acknowledge/cite their codes
  • CL-O to draft cover letter to auDA Board
  • Committee members to "sign off" Code on the list on 20/8.
