Handling Internet Domain Name Arbitration by William T. Fryer III [The Maryland Bar Journal - January/February 2008]
Abstract: This article reviews the administrative and legal actions that can be used to cancel or transfer a registered domain name that is in conflict with an earlier used trademark. For purposes of this article these alternative remedies will be referred to as a group by reference to the transfer step, the most common remedy used. The same analysis also can help guide a business in selecting a non-conflicting domain name. After analyzing the dispute resolution options, this article will suggest strategies that should be considered in selecting which domain name conflict resolution path to follow.

ICANN Looks at DNS Policy by George H. Pike [Information Today, September 2007]
Abstract: One of the more interesting facets of the Internet is that no one person, corporation, government, or group runs it as a whole. Different organizations have responsibility for setting and managing technical standards, Internet architecture, and the domain name system. And of course, the Internet’s information resources are provided by thousands of unique content suppliers.

On 26-27 August 2010, ICANN and its gTLD registration services providers will meet in Tokyo, Japan. Regional events, which ICANN has convened annually in Asia/Pacific, Europe and North America since 2006, are a chance for ICANN staff and representatives from gTLD registries and ICANN-accredited registrars to meet informally to discuss topics important to our industry and business relationships. ... What's wrong with Icann >> Kieren McCarthy
In a response on the Icann mailing list, McCarthy - a former insider at Icann, as well as a journalist - gives his thinking on how it gets it wrong: "My personal philosophy of why this vicious circle continues to persist is because ICANN lacks almost entirely a culture of learning from previous mistakes. Never has it had a review of the effectiveness of a particular process at the end of that process – despite this going against every best practice guidebook in the world.

IP Justice Comments on ICANN Accountability & Transparency Concerns: Lack of Accountability to Non-Commercial Users Remains Problematic for ICANN’s Promise to Protect the Public Interest
IP Justice is deeply concerned that ICANN is insufficiently accountable to relevant non-commercial interests. Certain interests, such as business interests (in particular the trademark and domain name industries) are over-represented at ICANN both in structure and in practice. On the other hand, non-commercial interests and individual Internet users are not given the appropriate representation, although some improvements have been made in recent years.

The domain name floodgates are about to open!
In brief: It will soon be possible for companies to register their own generic top level domain names, presenting an unprecedented opportunity for trade mark holders. However, there are significant technical requirements and costs involved and the number of domain name spaces that cybersquatters could use to capitalise on other people's trade marks could be significantly increased. Partner Tim Golder, Senior Associate Jesse Gleeson and Law Graduate Nadia Guadagno report.
