Court finds in favour of auDA in Bottle Domains proceedings

Judgement was handed down today in legal proceedings between auDA and Australian Style Pty Ltd t/a Bottle Domains, in favour of auDA.
The decision by Justice Hargrave of the Supreme Court of Victoria is available here.
In summary, the court found that a security breach affecting Bottle Domains occurred in April 2007 and that Bottle Domains' failure to immediately notify auDA of the security breach constituted a breach of the Registrar Agreement. The court upheld auDA's decision to terminate Bottle Domains' registrar accreditation on 15 April 2009.
Final orders will be made on 30 September 2009. auDA will make a further announcement at that time.
