Court delivers orders in Bottle Domains vs auDA proceedings

Orders were handed down today in legal proceedings brought against auDA by Australian Style Pty Ltd t/a Bottle Domains.
The court:
- dismissed Bottle’s application to overturn auDA's decision to terminate Bottle Domains' registrar accreditation on 15 April 2009 ;
- found that auDA’s actions in terminating Bottle’s Registrar Agreement, accreditation and connection to the .au registry were valid and effective; and
- ordered Bottle to pay auDA’s costs of the proceeding.
As Bottle has indicated that it wishes to appeal the decision, these orders have been stayed until 23 October 2009, and the injunction restraining auDA from giving effect to Bottle’s termination will continue until this date.
auDA will make a further announcement at that time.
