On 15 April 2009 auDA gave notice to Australian Style Pty Ltd trading as Bottle Domains to terminate its registrar accreditation, for failing to immediately notify auDA of a security breach affecting its systems in 2007.
Bottle Domains has brought proceedings against auDA in the Supreme Court of Victoria, challenging auDA's decision to terminate its accreditation.
On 25 September 2009, the Supreme Court of Victoria dismissed Bottle Domains' proceedings, and found that auDA was entitled to terminate Bottle Domains' accreditation. Bottle Domains is appealing the Supreme Court of Victoria's decision.
There is an order currently in place, made by the Court of Appeal, which prevents auDA from giving effect to its decision to terminate Bottle Domains' accreditation, until after the Court of Appeal hears and decides Bottle Domains' appeal.
