As a person that owns .com.au websites, I feel I should be giving the opportunity to match the name of my .com.au domain with the .au domain even if this is considered defensive. If I have a website that's for example, abcd.com.au and someone registers the domain abcd.au and uses the domain to create the same website that I have with the .com.au domain, how do I protect myself? It will certainly lead to loss of business, confusion from customers and possibly take legal action to protect myself. I'm sure I wouldn't be only with this problem. I'm not totally against people that don't own a certain .com.au domain to register the .au domain but current owners of .com.au should be giving priority to decide whether they want to register the .au domain or not.
